Terms of Service

These terms govern your use of Onset, an app for live musicians built by Andrea Libutti (VAT no. 18598921007). They also serve as an end-user license agreement (EULA), together with the terms of the store you download the app from. By using Onset, you accept the following.

1. What Onset is and beta status

Onset helps you manage setlists, lyrics and chords live. It is currently in beta: it is provided "as is", it may change, contain errors or stop working without notice. Always keep a copy of the content you care about.

2. License to use

We grant you a personal, non-exclusive, non-transferable license to use Onset on your devices, for personal or professional use as a musician, revocable if you breach these terms. The license does not give you ownership of the app.

If you download Onset from the App Store, Apple's standard EULA (Licensed Application End User License Agreement) also applies and, in case of conflict, prevails as regards distribution on iOS; Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. On Google Play, the Google Play terms of service also apply.

3. Your content is yours

Everything you create or import (songs, setlists, lyrics, chords, recordings) stays yours. Onset claims no rights over your content. You are, however, responsible for having the necessary rights to the materials you import or share: lyrics, sheet music and copyright-protected files remain subject to the rights of their respective owners, and their use is your responsibility.

When you generate a share link, you authorize us — solely to make sharing work — to store and transmit that content on our systems for 30 days. We may remove shared content that violates the law or others' rights: to report something, email [email protected].

5. Subscriptions and payments

Onset may offer paid features through a subscription. Purchases are handled by Apple (App Store) or Google (Play) and are also governed by their terms. We don't see your card details: payment stays between you and the store.

The subscription renews automatically at the end of each period, unless canceled at least 24 hours before expiry, from your App Store or Google Play account settings. Price and duration are shown in the app before purchase. If you are a consumer in the EU, you have the right to withdraw within 14 days of purchase: you exercise it directly through the store, which also handles refunds; by activating the paid features right away you consent to immediate performance of the service, as provided by law for digital content.

Prices may change: we'll let you know in advance, the increase will apply only from subsequent renewals, and you can always cancel before renewal.

6. Intellectual property

Onset, its name, logo and software are owned by Andrea Libutti. Nothing in these terms transfers to you any rights over the app beyond the license to use it.

7. No warranty

To the maximum extent permitted by law, Onset is provided "as is", without warranties of any kind. We do not guarantee that it is error-free, always available or fit for a specific use. As it is a beta, this applies all the more.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, loss of data or lost profits arising from the use (or inability to use) Onset, except in cases of willful misconduct or gross negligence. The rights that the law grants to consumers, which cannot be excluded, remain unaffected.

9. Suspension and termination

You can stop using Onset at any time by uninstalling it. We may suspend or discontinue the service, in whole or in part, especially during the beta phase; in that case we will do our best to give you reasonable advance notice. Should the service shut down while you have an active subscription, the subscription will not renew and you may ask the store for a refund of the unused period.

10. Governing law

These terms are governed by Italian law. For consumers, the court of their place of residence or domicile remains competent, where provided by law.

11. Changes

We may update these terms as the app evolves. We'll update the date at the top and, for significant changes, we'll flag it in the app and on this page.
